BUYA Loyalty Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the BUYA Loyalty software-as-a-service (SaaS) platform provided by BUYA Business ("BUYA", "we", "our", "us"). By accessing or using our Services, you agree to be bound by these Terms.
1. Overview of Services
BUYA is a subscription-based loyalty management platform enabling businesses to offer customer rewards via a whitelabeled mobile app and in-store kiosk interface. Customers can earn and redeem points using only their phone number and/or QR code (based on their number). The system functions with or without the customer downloading the app.
2. Eligibility
- You must be 18+ and authorized to enter into these Terms on behalf of a business.
- All registration information must be accurate and up to date.
3. Access and Use
Each subscription includes:
- A branded mobile app for iOS/Android.
- A web-based business dashboard.
- An in-store kiosk interface.
- The kiosk allows manual point management using customer phone numbers, even without QR scanning.
- All app and interface assets remain property of BUYA.
4. Subscription and Payment
- BUYA operates on a prepaid monthly subscription.
- All payments are processed securely via PayFast.
- If payment fails, you will enter a 60-day grace period.
- After 60 days without successful payment:
- Access to all systems is suspended.
- Data may be permanently deleted after an additional 30 days.
- No refunds will be provided for past periods.
5. Acceptable Use
You agree to:
- Use the platform legally and ethically.
- Prevent unauthorized or fraudulent access.
- Not copy, reverse-engineer, or resell the platform.
- Ensure staff follow all applicable terms.
BUYA reserves the right to revoke access in cases of abuse or violation.
6. Data Ownership and Privacy
- You own your customer and business data.
- BUYA owns and maintains the platform architecture.
- BUYA is a data processor under POPIA and GDPR and will:
- Not share or sell personal data.
- Maintain secure, encrypted infrastructure.
- Process data solely to deliver services.
7. Availability and Maintenance
- BUYA targets 99.9% uptime but cannot guarantee it.
- Downtime may occur due to scheduled maintenance or third-party issues.
- Platform may be updated or patched without prior notice.
8. Termination
- You may cancel your subscription via your admin panel.
- BUYA may suspend or terminate accounts due to:
- Extended payment failure.
- Terms violations.
- Malicious or illegal use.
9. Limitation of Liability
- BUYA is not liable for:
- Lost business or revenue.
- Delays in mobile app approvals.
- Third-party service failures.
- Our maximum liability is limited to fees paid in the last 3 months.
10. Changes to Terms
- We may update these Terms at any time.
- Continued use of the Services confirms your acceptance of any changes.
- You will be notified of significant amendments.
11. Legal Jurisdiction
- These Terms are governed by South African law.
- Disputes will be settled via arbitration in Pretoria, Gauteng.
